clarification regarding determination of residency
for tuition purposes and same sex domestic
partners of University employees

In determining residency for tuition purposes, the primary consideration is whether the student came to Illinois for education or to live. We use many factors in trying to assess the intent. For those married to University employees, we do not have to examine all these factors because it is clear the spouse came to Illinois to establish a domicile. The University has recognized same sex domestic partners in ways similar to married spouses. Therefore, it seems consistent to judge that same sex domestic partners of University employees came to Illinois to establish permanent domicile and should be classified as residents and assessed tuition at the in-state rate. To qualify, the employee and the domestic partner must complete and submit the UI Affidavit of Domestic Partnership form.
 
This is not a change in policy but an interpretation of existing policy and principles.
